In June 2016 the City Commission amended Yankton’s Sidewalk Cafe Ordinance to allow the consumption of alcoholic beverages on sidewalks adjacent to licensed establishments, consistent with changes in state law.  Applicants may now also propose the location of the pedestrian zone as a part of the application process.   As always, the primary purpose of the sidewalk is to provide a clearly identifiable corridor for pedestrian traffic; however, these updates allow the business owner additional ability to customize the cafe layout.

Some important considerations when planning your sidewalk cafe design:

  • Sidewalk cafes are permitted in a defined area of the B-3 Central Business District.  City staff can help identify if your business is located in that area. 
  • Outdoor food or beverage sales and outdoor dining may only occur on sidewalks that are adjacent to the building or structure in which the business providing the service is located.
  • A five foot wide pedestrian zone must be maintained, not including the curb zone, the two foot area nearest the curb.  The application will include the proposed location of a clearly identified and easily navigable pedestrian zone adjacent to the establishment.  The City Commission may adjust the location during the approval process, taking into consideration established pedestrian zones.
  • Once approved, the location of the pedestrian zone cannot change without City Commission action in the form of an amendment to an existing permit, or as a part of the annual renewal process.
  • No food or beverage service devices can be attached to the sidewalk or other public area.
  • All equipment must be moved indoors during non-business hours, unless the tables and chairs are secured to the building, or secured together in a preapproved fashion or constructed of such material and placed so that they cannot inadvertently be moved or blown by the wind.

A detailed scale drawing of the proposed location identifying the sidewalk cafe zone, curb zone, pedestrian zone, and all items to be placed on the sidewalk must be included with the application.  The application fee of $25.00 is payable upon submission of the annual application.
